By using toothhurty.ai (the "Service"), you agree to these terms. If you don't agree, please don't use the Service.
1. What the Service is
ToothHurty is a free educational tool. It asks about your dental symptoms, provides general educational information about what symptom patterns are commonly associated with and how promptly they typically deserve professional attention, and — only if you ask — shares your information with a local dental practice so they can contact you.
2. Not medical or dental advice
The Service does not provide medical or dental advice, diagnosis, or treatment. It is not a substitute for the judgment of a licensed dentist or physician. No dentist-patient or provider-patient relationship is created by using the Service. Always consult a qualified professional about your specific situation, and never disregard or delay professional care because of anything on this site.
3. Connections to dental practices
When you submit a connection request, you authorize us to share the information you provided (contact details, symptom summary, urgency level) with the dental practice we match you with, and you consent to that practice and ToothHurty contacting you about your request by phone, text message, or email. Standard message rates may apply. Participating practices are independent businesses — we don't control, and aren't responsible for, the care they provide, their availability, or their fees.
4. Acceptable use
Don't misuse the Service: no submitting false information or fake leads, no attempting to disrupt or reverse-engineer it, no using it for any unlawful purpose, and no scraping or reselling its content or output.
5. Intellectual property
The Service, including its content, design, and branding, belongs to ToothHurty. You may use it for personal, non-commercial purposes.
6. Disclaimers and limitation of liability
The Service is provided "as is" and "as available," without warranties of any kind, express or implied. AI-generated content can be incomplete or wrong. To the maximum extent permitted by law, ToothHurty and its operators will not be liable for any indirect, incidental, consequential, or special damages arising from your use of the Service, and our total liability for any claim will not exceed one hundred dollars ($100). Some jurisdictions don't allow certain limitations, so some of these may not apply to you.
7. Changes and termination
We may update the Service or these terms at any time; the effective date above reflects the latest version. Continued use after changes means you accept them. We may suspend or end access for misuse.
8. Governing law
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
